This Website shall not be used for any unlawful purpose including, without limitation, posting inaccurate, or false information about yourself or Goods and Services you may wish to sell on this Website or, posting material containing any virus or interfere with the operation of this Website or attempt to decipher, or modify any of the software, coding or information comprised in this Website.

Qlassified.com reserves the right, at its sole discretion, to pursue all of its legal remedies upon breach by you of these Terms of Use, including but not limited to deletion of your postings from this website, immediate termination of your registration and restricting your ability to access this website, or if Qlassified.com is unable to verify or authenticate any information you submit to this website.

3.      PROPRIETARY RIGHTS AND OWNERSHIP:

You acknowledge and agree that all content and materials available on this Site are protected by copyrights, trademarks, service marks, patents, trade secrets, or other proprietary rights and laws. Your use of this Site does not transfer to you any ownership or other rights in the content and materials therein. Except as expressly authorized by Qlassified.com, you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from such materials or content. Notwithstanding the above, you may print or download one copy of the materials or content on this Site on any single computer for your personal, non-commercial use, provided you keep intact all copyright and other proprietary notices. Systematic retrieval of data or other content from this Site to create or compile, directly or indirectly, a collection, compilation, database or directory without written permission from Qlassified.com is prohibited. In addition, use of the content or materials for any purpose not expressly permitted in these Terms of Use is prohibited.

As noted above, reproduction, copying, or redistribution for commercial purposes of any materials or design elements on this Site is strictly prohibited without the express written permission of Qlassified.com.

4.      Venue for Buying and Selling:

Qlassified.com is not an auctioneer although we are commonly referred to as an online auction web site. We are not a traditional auctioneer, instead, the Site acts as a venue which allows registered users to list, buy, and provide just about any service which is legal, at any time, from anywhere, to anywhere in a variety of service categories. We do not review project listings, bids, or any other information provided by users. We never provide services offered through the Site or are involved in transactions between customers and suppliers, which are represented by other users. As a result, we have no control over the quality, safety or legality of the services listed the truth or accuracy of the listings, the ability of suppliers to provide services or the ability of customers to pay for services rendered. Do not assume that the listing, offer, sale, purchase, export or import of any service is valid and legal simply because it is listed on the Site. We are not responsible for ensuring that customers and suppliers actually complete a transaction. You accept sole responsibility for the legality of your actions under laws applying to you.

5.      Membership Eligibility and information:

      I.        Our services are not available to, and may not be used by, persons under the age of 18 years. If you are under 18 years old, you can use this service only in conjunction with and under the supervision of a parent or guardian.

    II.        If you are registering as a business entity, you represent that you have the authority to bind that entity to this Terms of use.

   III.        You agree to keep your membership information, including email address, residential address, and telephone number, current at all times.

  IV.        You agree not to allow any other person to use the Qlassified.com website using your account and Member Name.

   V.        You may not include or provide your membership details (including your email residential address, phone number or other method of contact) on your profile, your listings, and your feedback or on the Qlassified.com Forums.

6.      Obligations of members:

      I.        Content. You agree that the content you post on Qlassified.com website:

• Will be true, accurate, and up-to-date;

• Will not be fraudulent or involve the sale of stolen items;

• Will not violate any law, statute, ordinance, or regulation (including without limitation those governing export control, consumer protection,

• Will not be defamatory, trade libellous, unlawfully threatening, or unlawfully harassing;

• Will not be obscene or contain child pornography

• Will not contain any viruses, Trojan horses, or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data, or personal information;

• Will not link directly or indirectly to or include descriptions of goods or services that (i) are prohibited under this Agreement or (ii) you do not have a right to link to or include;

    II.        Fees. Unless otherwise stated, all monetary values are quoted in Qatari Riyal (QAR). You are responsible for paying all applicable fees, taxes and duties and for all costs you incur as part of the Qlassified.com website. We may, at our sole discretion, change some or all of our services, and/or the fees for our services.

   III.        License. You agree to grant us a nonexclusive, worldwide, perpetual, irrevocable, royalty-free, sublicense able (through multiple tiers) right to exercise the copyright and publicity rights (but no other rights) you have in your posted content, in any media now known or not currently known.

  IV.        You agree that you will not use any device, software, or routine to interfere or attempt to interfere with the proper working of the Qlassified.com website or any transaction being conducted on our site. You may not take any action which imposes an unreasonable or disproportionately large load on our infrastructure. You may not disclose or share your Password to any third parties or use your Password for any unauthorized purpose.

   V.        You agree not to use a secondary account or third party to manipulate the outcome of a negotiation with another trader.

  VI.        Ratings. You may not take any actions which may undermine the integrity of the ratings system, such as leaving positive ratings for yourself using a secondary member account or third party, leaving negative ratings for other Members using secondary accounts or third parties, or leaving negative ratings if a Member fails to perform some action that is outside the scope of the transaction. If your Member rating is one star or lower, we may suspend your account, and you will no longer be able to participate in transactions.

 VII.        VII.            Compliance with laws. You shall comply with all applicable laws, statutes, ordinances and regulations regarding your use of our service and your negotiations, classified ad, purchase, and sale of items and services.

As you will receive other members contact information you agree to use this in relation to matters relating to the Qlassified.com transaction only. Such information must not be added to or sold on as mailing lists for Spam email or other such unsolicited activity. You should use this information in accordance with applicable laws including, without limitation, data protection and privacy laws. Further you must respect your trading partner and respond to their request should they ask you to remove their details from your records after a transaction is complete.

  IX.        Your obligations as a seller

·  Sellers must be located in Qatar. Sellers outside of these countries are not permitted to sell on Qlassified.com. Sellers must accept payment to a domestic Qatar bank account as one of their available payment options.

·  You will only enter listings that are accurate, current, complete, and include all relevant information about the terms of sale, payment terms, shipping methods and who bears the cost of shipment. You must list an item in one category only which must be the most appropriate category for your item.

·  You will only place listings for items that exist and are to be sold. You will not list items that you are not legally entitled to sell or that are not in your possession. In case of automobiles that are offshore or in transit to Qatar you must hold clear proof of ownership of such vehicles before being able to list them. You must also clearly indicate that such vehicles are offshore or in transit in the listing.

·  You must not sell illegal, offensive (including anything of a defamatory, pornographic, or racially or ethnically objectionable nature), stolen, or unsafe items, items which infringe copyright or other intellectual property rights, items which have been illegally imported or which would require illegal import or export in order to complete the transaction, or any item of which the sale is prohibited by, or violates any, law. You are responsible for ensuring that any item listed by you does not breach this agreement. You agree that Qlassified.com may disclose your personal information, including your name and contact details, to the relevant authorities, parties and/or the applicable intellectual property right holders (or their representatives) if we consider that you are in breach of this agreement at any time.

When you list an item for auction on Qlassified.com, you should do so with the intention of selling this item through the site. Therefore you should not advertise your item through another forum. If you remove a listing for an auction after bidding has begun, you will incur a non-refundable withdrawal fee, regardless of the reason.

·       Qlassified.com may be used by individuals or businesses to sell specific items only and must not be used for multiple or generic item listings.

·       Your listing may contain a URL for a website that contains further information on the item you have listed. However this website must not offer any items for sale, or contain contact details. You must not use Qlassified.com listings to promote a business or web site other than a Qlassified.com web site.

·       You must not use the services or the web site to sell items that are of a speculative nature including, but not limited to pyramid, surf-for-free, or similar schemes.

·       You must not manipulate prices through ghost-bidding or assuming multiple roles in a single transaction.

·       You will only list adult rated content (videos, magazines, DVD’s, etc) in the Adult category. Adult content listed in non-adult categories will be removed or moved to the adult category.

·       Listings are not pre-screened for content. Qlassified.com reserves the right to remove any listing that it deems unsuitable or in breach of the terms and conditions.

·       You must not link a listing to any page outside the web site unless the page directly promotes the sale of the items in the listing.

·       You must promptly forward the listed item to the successful buyer on completion of the transaction.

·       You must not charge unreasonable amounts for shipping and packaging costs.

   X.        Your obligations as a Buyer

·  You must be located in Qatar to buy on Qlassified.com. People outside of these countries are not permitted to purchase items of Qlassified.com.

·  Your bids are not retractable and you must only place a bid if you intend to buy the relevant item at the bid price entered. Reasonable allowances should be made for postage where applicable.

·   If you are notified that your bid has been successful, you must complete the transaction in the manner specified. By making a bid, you warrant and represent that you have the legal right to enter into and complete the transaction.

·  You must make full and prompt payment for an item bought by you.

·  You agree to your username and the amount of your bid being publicly shown on the Qlassified.com website.

·   If your bid is successful and you do not pay for the item, you will receive a warning from Qlassified.com if the seller complains about you. After 3 such complaints, Qlassified.com may suspend or terminate your membership.

·  You must only access the Adult category if you are at least 18 years old.

·  You may not bid on an auction that has been listed by a family member, flat mate, friend or any member that is personally known to you, in order to raise the price of that auction.

  XI.        Feedback

(a)    Feedback you provide on other members must not contain offensive, defamatory or inappropriate language. Qlassified.com reserves the sole right to determine what is considered offensive, defamatory or inappropriate language.

(b)   You may only give member feedback that relates to a specific transaction. You must not post feedback on a transaction that does not relate to that specific transaction.

(c) You must not post feedback about yourself or include any contact details or personal information in your feedback.

(d) Feedback is provided for the sole purpose of facilitating trading between members on the Qlassified.com web site. You must not market or export any feedback to any venue other than the Qlassified.com web site. Linking to your Qlassified.com feedback from other buying and selling websites will be considered a breach of our terms and conditions.

 XII.        Disputes. Qlassified.com website is not responsible for resolving disputes between parties.

Qlassified.com makes every effort to ensure the information presented in, on or through our Website is accurate, however, because we communicate information provided and created by advertisers, software developers, publishers, marketing agents, resellers and other third parties, we have no control over the accuracy of such information, and makes no guarantee as to such information, and is not responsible for the information, including its accuracy, currency, content, quality, copyright compliance or legality, or any resulting loss or damage.

THE WEBSITE AND THE MATERIALS ARE PROVIDED “AS IS" AND AS AVAILABLE, WITHOUT ANY WARRANTY OR REPRESENTATION OF ANY KIND, WHETHER EXPRESS OR IMPLIED. QLASSIFIED.COM EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, WITH RESPECT TO THE WEBSITE OR ANY MATERIALS.

8.      Limitation of Liability:

IN NO EVENT SHALL QLASSIFIED.COM BE LIABLE FOR ANY COMPENSATORY, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, LOSS OF DATA, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY, OR ANY CLAIMS OF YOU OR OTHER THIRD PARTIES WHATSOEVER WITH RESPECT TO THE WEBSITE OR THE MATERIALS REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, INCLUDING, WITHOUT LIMITATION, ANY DAMAGES THAT RESULT FROM ANY MISTAKE, OMISSION, VIRUS, DELAY OR INTERRUPTION IN OPERATION OR SERVICE OR FAILURE OF PERFORMANCE, WHETHER OR NOT RESULTING FROM AN ACT OF GOD, COMMUNICATIONS FAILURE, THEFT OR OTHERWISE. QLASSIFIED.COM SHALL NOT BE LIABLE FOR ANY LOSSES OR DAMAGES WHATSOEVER RESULTING FROM ANY FAILURE OF THE INTERNET.

9.      Release:

YOU HEREBY RELEASE, REMISE AND FOREVER DISCHARGE QLASSIFIED.COM AND ITS LICENSORS AND EACH OF THEIR RESPECTIVE AGENTS, DIRECTORS, OFFICERS, EMPLOYEES, INFORMATION PROVIDERS, SERVICE PROVIDERS, SUPPLIERS, LICENSORS AND LICENSEES, AND ALL OTHER RELATED, ASSOCIATED, OR CONNECTED PERSONS FROM ANY AND ALL MANNER OF RIGHTS, CLAIMS, COMPLAINTS, DEMANDS, CAUSES OF ACTION, PROCEEDINGS, LIABILITIES, OBLIGATIONS, LEGAL FEES, COSTS, AND DISBURSEMENTS OF ANY NATURE AND KIND WHATSOEVER AND HOWSOEVER ARISING, WHETHER KNOWN OR UNKNOWN, WHICH NOW OR HEREAFTER EXIST, WHICH ARISE FROM, RELATE TO, OR ARE CONNECTED WITH YOUR USE OF THE SITE.

10.  Indemnity:
You agree to defend, indemnify and hold Qlassified.com and (as applicable) its officers, directors, employees, agents, subsidiaries, affiliates, suppliers and any of our third party information service providers or other representatives harmless against any and all claims demands, losses, expenses, damages and costs, including legal costs, however arising resulting from any violation or breach by you of these Terms of Use or any claims made by or liabilities to any third party resulting from any activities conducted under your account, your use or misuse of this website, including but not limited to posting content on this website, entering into transactions with other website users, contacting others as a result of their postings on this website, infringing any third party’s intellectual property or other rights, or otherwise arising out of your breach of these Terms of Use.

11.  Suspension/Termination:

We may immediately issue a warning, temporarily suspend, indefinitely suspend, or terminate your membership, any of your current classifieds, and any other information you place on the site if you breach this Agreement or if we are unable to verify or authenticate any information you provide to us. Without limiting any other remedies, Qlassified.com may suspend or terminate your account if you are found (by conviction, settlement, insurance or escrow investigation, or otherwise) to have engaged in fraudulent activity in connection with our site.

12.  Jurisdiction and Venue:

This Agreement shall be governed in all respects by the laws of the State of Qatar. You agree that any legal action brought against Qlassified.com shall be governed by the laws of the State of Qatar without regard to its conflict of law principles, and that the sole jurisdiction and venue for any litigation arising from your use of Qlassified.com shall be an appropriate federal or state court located in the State of Qatar. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe, or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.

13.  Other Agreements:

If you and Qlassified.com have entered into a separate written agreement that covers your use of Qlassified.com, the terms and conditions of such agreement shall control to the extent they are inconsistent with this Member Agreement.
